Terms and Conditions (T&Cs)

1. Purpose

These Terms and Conditions of Sale govern the sale of usage licenses for musical instrumentals via the website www.breezyjanuary.com. Any purchase implies full and complete acceptance of these Terms and Conditions.

 

2. Products

The products sold are non-exclusive licenses ("Basic", "Standard", "Pro", "Ultimate") for musical compositions in digital format.

The buyer may use the instrumental according to the terms of use specified in the license. However, the instrumental remains available for sale to other artists.

Breezy January retains the intellectual property of its compositions as well as its copyright and publishing rights, unless a custom contract has been established.

All details regarding usage rights, limitations, delivered formats, and specific conditions for each license are available in the "Licenses" section of the site. A corresponding contract is automatically generated and sent to the buyer after each order.

 

3. Pricing

Prices are shown in euros, all taxes included (VAT not applicable – Article 293 B of the French General Tax Code). Users may select another currency (USD or CHF). Payment is made in a single installment via Stripe or PayPal.

Payment is due in full at the time of order.

 

4. Delivery

Files (MP3, WAV, separated tracks – depending on the license) are sent immediately after payment by email or via a secure download link.

5. Right of Withdrawal

In accordance with Article L221-28 of the French Consumer Code, the right of withdrawal does not apply to digital content provided immediately after payment.

The buyer acknowledges expressly waiving this right. Any exceptional request will be reviewed on a case-by-case basis.

 

6. Intellectual Property and Restrictions

The buyer may not resell, transfer, or sublicense the purchased beats.

It is strictly forbidden to register the beats with Content ID systems (YouTube, DistroKid, TuneCore, etc.).

Breezy January retains all copyright and publishing rights, unless a specific contract states otherwise.

Any breach will result in immediate cancellation of the license, without refund.

 

7. Disputes

In the event of a dispute, an amicable solution will be sought first. Failing that, French courts shall have jurisdiction.

 

8. Seller's Liability

Breezy January cannot be held liable for:

• Temporary interruptions of the site
• Conflicts related to the buyer's use of the music
• Disputes with platforms (YouTube, Spotify, etc.)
• Non-compliant use of the licenses

9. Personal Data Protection

Personal data collected is used solely to process orders. See our Privacy Policy.

 

10. Changes to These Terms

Breezy January reserves the right to modify these Terms and Conditions at any time. The applicable terms are those in effect at the date of purchase.

 

11. Terms of Use of the Website

I. Site Access

The site is accessible 24/7, except for maintenance or force majeure.

II. Use of Content

All content on the site is the property of Breezy January. Any reproduction or distribution without authorization is prohibited.

III. User Conduct

Users agree not to:

• Use the site for illegal purposes
• Attempt to access protected areas
• Compromise the security or functioning of the site

IV. External Links

Breezy January disclaims any responsibility regarding the content of referenced external sites.

V. Intellectual Property

The beats, texts, and visuals are protected by copyright. No rights are transferred to the user.

VI. Changes to These Terms

These terms may be modified at any time without notice. The online version shall prevail.
